E i marketplace sono obbligati a bloccare le vendite quando mancano i numeri richiesti.<\/span>\n<h2><b>Le tre normative tedesche: quadro chiaro e sintetico<\/b><\/h2>\n<span style=\"font-weight: style=\"font-weight: 400;\"> (imballato? elettronica? batterie?), poi vedi <\/span><b>quale legge<\/b><span style=\"font-weight: 400;\"> si applica.<\/span>\n<h2><b>Quando sei considerato \u201cproduttore\u201d secondo l\u2019EPR Germania<\/b><\/h2>\n<span style=\"font-weight: 400;\">Nel sistema tedesco, \u201cproduttore\u201d non significa per forza chi fabbrica il prodotto in fabbrica, ma <\/span><b>chi lo immette per primo sul mercato tedesco<\/b><span style=\"font-weight: 400;\">.<\/span>\n\n<span style=\"font-weight: 400;\">I casi tipici:<\/span>\n<h3><b>Spedisci da un altro Paese UE verso la Germania<\/b><\/h3>\n<span style=\"font-weight: 400;\">Se vendi dalla tua sede in Italia, Spagna, Polonia\u2026 e spedisci a un cliente tedesco:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">agli occhi della normativa sei <\/span><b>importatore<\/b><span style=\"font-weight: 400;\"> per la Germania<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">quindi rientri nel concetto di <\/span><b>produttore<\/b><span style=\"font-weight: 400;\"> ai fini EPR<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Esempi:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">vendi su Amazon.de spedendo dall\u2019Italia<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">hai un magazzino in un altro Paese UE e da l\u00ec spedisci ai clienti in Germania<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">In tutti questi casi l\u2019EPR Germania ti riguarda.<\/span>\n<h3><b>Spedisci da Paesi extra-UE<\/b><\/h3>\n<span style=\"font-weight: 400;\">Se spedisci alla Germania da UK, USA, Cina o altri Paesi terzi, la logica \u00e8 la stessa, ma in modo ancora pi\u00f9 diretto:<\/span><span style=\"font-weight: 400;\">\n<\/span><span style=\"font-weight: 400;\"> sei tu che porti il prodotto nel mercato tedesco, quindi sei produttore a pieno titolo.<\/span>\n<h3><b>Hai un tuo brand (private label)<\/b><\/h3>\n<span style=\"font-weight: 400;\">Se il prodotto arriva in Germania con il <\/span><b>tuo marchio<\/b><span style=\"font-weight: 400;\"> visibile (sul packaging o sul prodotto):<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">sei considerato <\/span><b>produttore<\/b><span style=\"font-weight: 400;\"> per quel brand<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">devi registrare il tuo marchio per WEEE e\/o Batterie se \u00e8 elettronico \/ contiene batterie<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">per gli imballaggi ti serve comunque <\/span><b>LUCID Germania<\/b><\/li>\n<\/ul>\n<h3><b>Fai dropshipping<\/b><\/h3>\n<span style=\"font-weight: 400;\">Il dropshipping non ti mette al riparo dagli obblighi.<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se il fornitore \u00e8 <\/span><b>registrato correttamente<\/b><span style=\"font-weight: 400;\"> in Germania (WEEE\/BattG\/LUCID) \u2192 puoi usare i suoi numeri dove consentito.<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Se il fornitore <\/span><b>non \u00e8 registrato<\/b><span style=\"font-weight: 400;\"> o non ti fornisce le prove \u2192 per la legge tedesca il produttore diventi tu.<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">\u00c8 un punto critico soprattutto con fornitori extra-UE.<\/span>\n<h3><b>Rivendi marchi di terzi<\/b><\/h3>\n<span style=\"font-weight: 400;\">Se rivendi prodotti di brand noti o di terzi, la regola \u00e8:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">se il <\/span><b>marchio \u00e8 gi\u00e0 registrato<\/b><span style=\"font-weight: 400;\"> in Germania presso Stiftung EAR per quella categoria \u2192 tu sei solo distributore, non devi registrare di nuovo il brand per il WEEE\/BattG<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">se il marchio <\/span><b>non risulta registrato<\/b><span style=\"font-weight: 400;\"> \u2192 chi lo immette sul mercato (spesso tu) deve fare la registrazione<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Puoi verificare i marchi nel <\/span><b>registro pubblico EAR<\/b><span style=\"font-weight: 400;\"> (ricerca per legge di riferimento \u00e8 il <\/span><b>VerpackG<\/b><span style=\"font-weight: 400;\">, e richiede due cose:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">registrazione dell\u2019azienda sul <\/span><b>registro LUCID Germania<\/b><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">contratto con un <\/span><b>sistema duale<\/b><span style=\"font-weight: 400;\"> per il riciclo degli imballaggi<\/span><\/li>\n<\/ul>\n<h3><b>Cos\u2019\u00e8 il registro LUCID<\/b><\/h3>\n<a href=\"https:\/\/muaytax.com\/it\/lucid-germania\/\"><b>LUCID<\/b><\/a><span style=\"font-weight: 400;\"> \u00e8 il registro ufficiale degli imballaggi gestito dalla <\/span><b>Zentrale Stelle Verpackungsregister (ZSVR)<\/b><span style=\"font-weight: 400;\">.<\/span>\n\n<span style=\"font-weight: 400;\">Caratteristiche importanti:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00e8 <\/span><b>pubblico e consultabile da tutti<\/b><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">i competitor e i marketplace possono verificare se un\u2019azienda \u00e8 registrata<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">se non sei su LUCID Germania, teoricamente non puoi spedire imballaggi a clienti tedeschi<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Per questo i marketplace verificano regolarmente la presenza di un numero LUCID valido.<\/span>\n<h3><b>Quali imballaggi rientrano nella normativa<\/b><\/h3>\n<span style=\"font-weight: 400;\">In pratica quasi tutto quello che il cliente tedesco deve buttare dopo aver ricevuto il prodotto:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">scatole e confezioni dei prodotti<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">imballaggi di spedizione (cartoni, buste, sacchetti)<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">materiali di riempimento e protezione (plastica, carta, pluriball)<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">imballaggi secondari (pellicole, fasce, etichette)<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Non conta se spedisci 1 pacco o 1.000: <\/span><b>la registrazione LUCID Germania \u00e8 obbligatoria anche per pochi colli<\/b><span style=\"font-weight: 400;\">.<\/span>\n<h3><b>Tempistiche realistiche<\/b><\/h3>\n<span style=\"font-weight: 400;\">La parte imballaggi \u00e8 la pi\u00f9 veloce:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>registrazione LUCID<\/b><span style=\"font-weight: 400;\">: di solito in circa <\/span><b>1 settimana<\/b><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>contratto con sistema duale<\/b><span style=\"font-weight: 400;\">: spesso attivabile in 24\u201348 ore<\/span><\/li>\n<\/ul>\n<h2><b>Come funziona la registrazione LUCID e cosa serve<\/b><\/h2>\n<span style=\"font-weight: 400;\">Per essere davvero in regola con gli <\/span><b>imballaggi Germania<\/b><span style=\"font-weight: 400;\"> servono tre passaggi.<\/span>\n<h3><b>1) Registrazione al registro LUCID Germania<\/b><\/h3>\n<span style=\"font-weight: 400;\">L\u2019azienda viene registrata nel portale della ZSVR.<\/span><span style=\"font-weight: 400;\">\n<\/span><span style=\"font-weight: 400;\"> In questa fase vengono richiesti, tra gli altri:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">dati aziendali e del legale rappresentante<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">partita IVA italiana<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">indirizzo operativo<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">eventuali marchi utilizzati per la vendita<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Alla fine ricevi un <\/span><b>numero LUCID<\/b><span style=\"font-weight: 400;\">, che va comunicato anche ai marketplace che lo richiedono (es. Amazon, eBay).<\/span>\n<h3><b>2) Contratto con un sistema duale<\/b><\/h3>\n<span style=\"font-weight: 400;\">Il sistema duale \u00e8 il soggetto che si occupa del <\/span><b>riciclo effettivo<\/b><span style=\"font-weight: 400;\"> degli imballaggi.<\/span>\n\n<span style=\"font-weight: 400;\">Il contratto prevede:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">una stima dei kg di imballaggi che immetterai (plastica, carta, vetro, ecc.)<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">il pagamento di un contributo ambientale<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">la dichiarazione a fine anno delle quantit\u00e0 effettive<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Senza sistema duale attivo, la sola iscrizione LUCID non \u00e8 considerata sufficiente.<\/span>\n<h3><b>3) Dichiarazioni annuali<\/b><\/h3>\n<span style=\"font-weight: 400;\">Ogni anno l\u2019azienda deve:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">dichiarare le quantit\u00e0 effettive di imballaggi immesse sul mercato tedesco<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">in alcuni casi (grandi volumi), presentare una <\/span><b>dichiarazione di completezza<\/b><span style=\"font-weight: 400;\"> certificata<\/span><\/li>\n<\/ul>\n<h3><b>Documenti che ti chiediamo per gestire la pratica<\/b><\/h3>\n<span style=\"font-weight: 400;\">Per tutta la parte <\/span><b>EPR imballaggi Germania (LUCID)<\/b><span style=\"font-weight: 400;\"> richiediamo normalmente:<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">documento di identit\u00e0 del titolare \/ legale rappresentante<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>visura camerale<\/b><span style=\"font-weight: 400;\"> aggiornata<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">oppure
