{"id":55927,"date":"2026-01-21T12:47:57","date_gmt":"2026-01-21T11:47:57","guid":{"rendered":"https:\/\/muaytax.com\/?p=55927"},"modified":"2026-01-21T12:52:50","modified_gmt":"2026-01-21T11:52:50","slug":"quelles-sont-les-filieres-rep","status":"publish","type":"post","link":"https:\/\/muaytax.com\/fr\/quelles-sont-les-filieres-rep\/","title":{"rendered":"Quelles sont les fili\u00e8res REP ?"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"55927\" class=\"elementor elementor-55927\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-284ac9a e-flex e-con-boxed e-con e-parent\" data-id=\"284ac9a\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-1320e07 elementor-widget elementor-widget-text-editor\" data-id=\"1320e07\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2 id=\"qu-est-ce-qu-une-filiere-rep-et-pourquoi-ce-dispositif-existe\"><b>Qu\u2019est-ce qu\u2019une fili\u00e8re REP et pourquoi ce dispositif existe ?<\/b><\/h2>\n<span style=\"font-weight: 400;\">Une <\/span><b>fili\u00e8re REP<\/b><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/muaytax.com\/fr\/responsabilite-elargie-du-producteur-guide\/\"><span style=\"font-weight: 400;\">Responsabilit\u00e9 \u00c9largie du Producteur<\/span><\/a><span style=\"font-weight: 400;\">) d\u00e9signe un <\/span><b>dispositif r\u00e9glementaire<\/b><span style=\"font-weight: 400;\"> par lequel les entreprises qui mettent des produits sur le march\u00e9 fran\u00e7ais sont tenues de <\/span><b>prendre en charge la gestion de leurs d\u00e9chets<\/b><span style=\"font-weight: 400;\">, depuis leur collecte jusqu\u2019\u00e0 leur recyclage en fin de vie.<\/span>\n\n<span style=\"font-weight: 400;\">Sont consid\u00e9r\u00e9s comme <\/span><b>producteurs <\/b><span style=\"font-weight: 400;\">les fabricants, importateurs ou marques qui commercialisent des produits en France et supportent le co\u00fbt de la gestion des d\u00e9chets.<\/span>\n\n<span style=\"font-weight: 400;\">Chaque <\/span><b>fili\u00e8re REP<\/b><span style=\"font-weight: 400;\"> correspond \u00e0 une <\/span><b>cat\u00e9gorie de produits sp\u00e9cifique<\/b><span style=\"font-weight: 400;\"> (emballages, \u00e9quipements \u00e9lectriques, textiles, meubles, etc.).\u00a0<\/span>\n\n<span style=\"font-weight: 400;\">Dans la majorit\u00e9 des cas, les producteurs remplissent leurs obligations en <\/span><b>adh\u00e9rant \u00e0 un \u00e9co-organisme agr\u00e9\u00e9<\/b><span style=\"font-weight: 400;\">, qui mutualise les contributions financi\u00e8res des entreprises afin d\u2019organiser la collecte, le tri, le recyclage ou la valorisation des d\u00e9chets concern\u00e9s. Dans certains cas plus sp\u00e9cifiques, une entreprise peut toutefois opter pour un <\/span><b>syst\u00e8me individuel<\/b><span style=\"font-weight: 400;\">, sous r\u00e9serve de respecter des conditions strictes.<\/span>\n\n<span style=\"font-weight: 400;\">L\u2019objectif des fili\u00e8res REP est double :<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>r\u00e9duire l\u2019impact environnemental<\/b><span style=\"font-weight: 400;\"> des produits mis sur le march\u00e9,<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/muaytax.com\/fr\/conception-produit-et-rep\/\"><b>encourager l\u2019\u00e9co-conception<\/b><\/a><span style=\"font-weight: 400;\">, en incitant les entreprises \u00e0 concevoir des produits plus durables, recyclables ou r\u00e9parables.<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Avec l\u2019entr\u00e9e en vigueur de la <\/span><b>loi AGEC<\/b><span style=\"font-weight: 400;\"> (anti-gaspillage pour une \u00e9conomie circulaire), le nombre de fili\u00e8res REP a fortement augment\u00e9 et les contr\u00f4les se sont renforc\u00e9s. R\u00e9sultat : la conformit\u00e9 aux fili\u00e8res REP est devenue un <\/span><b>enjeu central pour les entreprises<\/b><span style=\"font-weight: 400;\">, en particulier pour les acteurs de l\u2019e-commerce et les vendeurs internationaux souhaitant op\u00e9rer en France.<\/span>\n<h2 id=\"quelles-entreprises-sont-concernees-par-une-filiere-rep\"><b>Quelles entreprises sont concern\u00e9es par une fili\u00e8re REP ?<\/b><\/h2>\n<span style=\"font-weight: 400;\">La conformit\u00e9 aux fili\u00e8res REP concerne toute entreprise qui met un produit sur le march\u00e9 fran\u00e7ais peut \u00eatre soumise \u00e0 une ou plusieurs fili\u00e8res REP, quelle que soit sa taille ou son pays d\u2019\u00e9tablissement.<\/span>\n<h3 id=\"la-notion-de-producteur\"><b>La notion de producteur\u00a0<\/b><\/h3>\n<span style=\"font-weight: 400;\">Dans le cadre des fili\u00e8res REP, est consid\u00e9r\u00e9 <\/span><b>producteur<\/b><span style=\"font-weight: 400;\"> toute entreprise qui, \u00e0 titre professionnel :<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">fabrique des produits en France et les commercialise sous son nom ou sa marque ;<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">importe ou introduit des produits en France depuis un autre pays (Union europ\u00e9enne ou pays tiers) ;<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">vend des produits sous sa propre marque, m\u00eame si la fabrication est sous-trait\u00e9e ;<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">met pour la premi\u00e8re fois un produit sur le march\u00e9 fran\u00e7ais.<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Autrement dit, <\/span><b>l\u2019obligation REP repose sur celui qui d\u00e9cide de la mise en march\u00e9<\/b><span style=\"font-weight: 400;\">, et non sur les interm\u00e9diaires logistiques ou les prestataires techniques.<\/span>\n\n<span style=\"font-weight: 400;\">Ce point est essentiel, car une m\u00eame cha\u00eene de distribution peut impliquer plusieurs acteurs, mais un seul <\/span><b>sera responsable des obligations REP<\/b><span style=\"font-weight: 400;\"> pour un produit donn\u00e9.<\/span>\n<h3 id= cas-frequents-dans-l-e-commerce-et-sur-les-marketplaces><b>Cas fr\u00e9quents dans l\u2019e-commerce et sur les marketplaces<\/b><\/h3>\n<span style=\"font-weight: 400;\">Les fili\u00e8res REP concernent de plus en plus les acteurs du e-commerce, y compris les entreprises \u00e9tablies hors de France.<\/span>\n\n<span style=\"font-weight: 400;\">Sont notamment concern\u00e9es :<\/span>\n<ul>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les <\/span><b>vendeurs e-commerce fran\u00e7ais<\/b><span style=\"font-weight: 400;\"> commercialisant des produits soumis \u00e0 une fili\u00e8re REP ;<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les <\/span><b>entreprises \u00e9trang\u00e8res<\/b><span style=\"font-weight: 400;\"> vendant directement \u00e0 des clients situ\u00e9s en France ;<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les <\/span><a href=\"https:\/\/muaytax.com\/fr\/marketplaces-guide-complet-ventes-en-ligne\/\"><b>vendeurs sur marketplaces<\/b><\/a><span style=\"font-weight: 400;\"> (Amazon, Cdiscount, etc.), d\u00e8s lors qu\u2019ils sont identifi\u00e9s comme metteurs sur le march\u00e9 ;<\/span><\/li>\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les entreprises important des produits et les stockant en France avant leur vente.<\/span><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Le fait de vendre via une marketplace ne dispense pas automatiquement des obligations REP. M\u00eame si certaines plateformes peuvent assumer une partie des obligations dans des cas pr\u00e9cis, le vendeur reste g\u00e9n\u00e9ralement responsable de sa conformit\u00e9, notamment pour l\u2019identification de la fili\u00e8re, l\u2019adh\u00e9sion \u00e0 un \u00e9co-organisme et l\u2019obtention de l\u2019IDU.<\/span>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ea53d62 e-con-full e-flex e-con e-parent\" data-id=\"ea53d62\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-8e0771a elementor-widget elementor-widget-text-editor\" data-id=\"8e0771a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h2 id=\"comment-identifier-la-filiere-rep-applicable-a-vos-produits\"><b>Comment identifier la fili\u00e8re REP applicable \u00e0 vos produits\u00a0<\/b><\/h2><p><span style=\"font-weight: 400;\">Il est essentiel <\/span><a href=\"https:\/\/muaytax.com\/fr\/tva\/responsabilite-elargie-du-producteur\/rep-choisir-filiere\/\"><span style=\"font-weight: 400;\">d\u2019identifier correctement la fili\u00e8re REP applicable<\/span><\/a><span style=\"font-weight: 400;\"> afin d\u2019\u00e9viter toute erreur de rattachement et de s\u00e9curiser votre conformit\u00e9 d\u00e8s la mise sur le march\u00e9. Identifier la<\/span><b> fili\u00e8re REP<\/b><span style=\"font-weight: 400;\"> ne d\u00e9pend ni de votre statut juridique ni de votre pays d\u2019\u00e9tablissement, <\/span><b>mais des caract\u00e9ristiques des produits que vous mettez sur le march\u00e9 fran\u00e7ais<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Un m\u00eame vendeur peut d\u2019ailleurs \u00eatre concern\u00e9 par <\/span><b>plusieurs fili\u00e8res REP<\/b><span style=\"font-weight: 400;\">, d\u00e8s lors qu\u2019il commercialise diff\u00e9rentes cat\u00e9gories de produits. Pour savoir quelle fili\u00e8re REP s\u2019applique, l\u2019analyse repose principalement sur les \u00e9l\u00e9ments suivants :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>la nature du produit<\/b><span style=\"font-weight: 400;\"> : \u00e9quipement \u00e9lectrique, emballage, textile, meuble, jouet, etc ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>l\u2019usage du produit<\/b><span style=\"font-weight: 400;\"> : usage domestique ou professionnel, usage unique ou durable ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>les mat\u00e9riaux qui le composent<\/b><span style=\"font-weight: 400;\"> : plastique, papier, carton, m\u00e9tal, bois, composants \u00e9lectroniques ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>le mode de mise sur le march\u00e9<\/b><span style=\"font-weight: 400;\"> : fabrication en France, importation, vente sous marque propre.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">La r\u00e9glementation d\u00e9finit pour chaque fili\u00e8re un p\u00e9rim\u00e8tre pr\u00e9cis, avec des cat\u00e9gories et sous-cat\u00e9gories de produits. Il est donc important de se r\u00e9f\u00e9rer aux d\u00e9finitions officielles afin d\u2019\u00e9viter toute erreur de rattachement.<\/span><\/p><h3 id=\"exemples-de-filieres-rep-les-plus-courantes\"><b>Exemples de fili\u00e8res REP les plus courantes<\/b><\/h3><p><span style=\"font-weight: 400;\">Certaines fili\u00e8res REP concernent un tr\u00e8s grand nombre d\u2019entreprises, notamment dans l\u2019e-commerce. Parmi les plus fr\u00e9quentes, on retrouve les fili\u00e8res suivantes :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>emballages<\/b><span style=\"font-weight: 400;\">, qui s\u2019applique \u00e0 la majorit\u00e9 des produits vendus aux consommateurs ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u00e9l\u00e9ments d\u2019ameublement (DEA)<\/b><span style=\"font-weight: 400;\"> ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u00e9quipements \u00e9lectriques et \u00e9lectroniques (DEEE)<\/b><span style=\"font-weight: 400;\"> ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>piles et batteries<\/b><span style=\"font-weight: 400;\"> ;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>produits textiles<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Ces exemples montrent que des produits tr\u00e8s diff\u00e9rents peuvent relever de fili\u00e8res distinctes, m\u00eame lorsqu\u2019ils sont vendus par une seule et m\u00eame entreprise.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-bcafaec
